Flashy Marketplace – Terms and Conditions

These Terms and Conditions (“Agreement”) govern your use of Flashy Marketplace (app.flashyvideos.com), a platform operated by Flashy International Ltd. By accessing or using Flashy Marketplace, you agree to be legally bound by these terms. If you do not agree, you must not use the Platform.

This Agreement is in compliance with the Indian Contract Act, 1872, the Information Technology Act, 2000, and applicable international laws.

1. DEFINITIONS

“Platform” – Flashy Marketplace (app.flashyvideos.com).

“User” – Any individual or entity using the Platform, including both buyers and sellers.

“Buyer” – A user purchasing services through the Platform.

“Seller” – A user offering services through the Platform.

“Service Listing” – Digital services provided by a Seller.

“Order” – A confirmed transaction between a Buyer and a Seller.

“Flashy International Ltd” – The company operating Flashy Marketplace.

2. GENERAL TERMS

2.1 Eligibility

Users must be 18 years or older. Users under 18 require parental consent.

Users must not be subject to Indian or international economic sanctions.

2.2 ACCOUNT REGISTRATION

2.2.1 Accurate Information Requirement: Users must provide accurate, complete, and up-to-date information during registration, including name, phone number, email address, and billing details. This information is for Flashy Marketplace’s internal use only and will not be visible to other users (buyers or sellers) on the platform.

2.2.2 Single Account Policy: Users must not create multiple accounts for any reason. Duplicate accounts may be suspended or permanently banned.

2.2.3 Account Security: Users are responsible for maintaining the security of their account credentials. Flashy Marketplace will not be liable for any unauthorized access due to user negligence. If a user suspects unauthorized access, they must report it immediately to Flashy Marketplace support.

2.3 Prohibited Conduct

  • Engage in fraudulent, misleading, or deceptive practices.
  • Conduct transactions outside Flashy Marketplace.
  • Post illegal, defamatory, obscene, or copyrighted content without permission.

3. TERMS FOR BUYERS

3.1 Payments & Fees

Buyers must pay in advance for services.

A 10% platform fee applies to each transaction.

Indian buyers are subject to 18% GST.

3.2 Orders & Refunds

Orders are confirmed upon payment.

Buyers must provide clear service requirements.

Refunds are at Flashy Marketplace’s discretion.

3.3 Reviews & Disputes

Buyers must leave genuine, unbiased reviews.

Fake or manipulated reviews are prohibited.

Disputes will be resolved by Flashy Marketplace, with decisions being final.

4. TERMS FOR SELLERS

4.1 Service Listings & Responsibilities

Sellers must provide accurate descriptions and deliver work on time.

False advertising and misleading claims are prohibited.

Sellers cannot promote their services using Google Ads or third-party ads.

4.2 Earnings & Withdrawals

Sellers receive payouts post-order completion.

A 10% platform fee is deducted from earnings.

Indian sellers must comply with tax laws.

Identity verification is required before withdrawal.

4.3 Dispute Resolution

Disputes are handled based on platform policies.

Refunds and cancellations are determined by Flashy Marketplace.

5. PAYMENT TERMS

Payments are processed through secure payment gateways.

Chargebacks may result in account suspension.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership and Usage Rights

Buyers are granted a worldwide, non-exclusive, royalty-free license to use the delivered work for commercial or personal use, unless otherwise specified in the Service Listing.

Sellers retain all ownership rights to the original materials, methodologies, and know-how used in creating the service, except for the final delivered work.

Buyers may not resell, redistribute, or modify the delivered work without prior agreement from the Seller.

For services where a custom license or extended rights purchase is available, Buyers must purchase the appropriate rights if they wish to use the work beyond personal use.

6.2 Flashy Marketplace License Grant

By uploading content (Service Listings, descriptions, images, etc.), Sellers grant Flashy Marketplace a worldwide, non-exclusive, royalty-free, sublicensable license to use the content for marketing, advertising, and promotional purposes.

6.3 Copyright & Trademark Compliance

Sellers must not use copyrighted material unless they have the appropriate rights.

Any copyright infringement may result in account termination.

6.4 Reporting IP Violations

If a user believes their intellectual property has been infringed, they may file a DMCA or legal complaint with Flashy Marketplace for review.

7. TERMINATION & ACCOUNT SUSPENSION

Flashy Marketplace reserves the right to suspend or terminate accounts for violations of these Terms.

Users may not re-register after account termination.

8. LIMITATION OF LIABILITY

Flashy Marketplace is not responsible for interactions outside the Platform.

Flashy Marketplace does not guarantee service quality or performance.

Flashy Marketplace is not liable for lost earnings due to account suspension.

9. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by Indian law, with jurisdiction in Delhi, India.

Disputes shall be resolved through arbitration in Delhi, India, per the Arbitration and Conciliation Act, 1996.

10. CHANGES & UPDATES

Flashy Marketplace reserves the right to modify these Terms at any time.

Users will be notified via email or platform notifications.

11. CONTACT INFORMATION & COMMUNICATION RESTRICTIONS

11.1 Prohibited Contact Sharing

Users (both buyers and sellers) must not share personal contact details, including but not limited to:

  • Email addresses
  • Phone numbers
  • Social media handles (e.g., WhatsApp, Telegram, Instagram, LinkedIn, etc.)
  • External website links
  • Payment details outside the platform
  • Video conferencing links (e.g., Google Meet, Zoom, Microsoft Teams, Skype, etc.)
  • Full names (including first name, middle name, and last name in any combination) in service listings or profile descriptions.

All communication must be conducted exclusively within the Flashy Marketplace messaging system.

11.2 Consequences of Violations

Sharing contact information or external links may result in account suspension or termination.

Orders completed outside Flashy Marketplace are not eligible for dispute resolution, refunds, or platform protection.

12. REFUNDS POLICY

12.1 Refund Policy for Buyers

Buyers may be eligible for a refund under the following conditions:

  • The seller fails to deliver the service within the agreed timeframe.
  • The delivered service does not match the agreed-upon description.
  • There is clear evidence of fraudulent activity or violation of Flashy Marketplace policies by the seller.

Refund requests must be submitted within 7 days of order completion.

Refunds are processed only through the original payment method, and processing fees may be deducted.

Refunds are at the sole discretion of Flashy Marketplace, and decisions made by the platform are final and binding.

12.2 Refund Policy for Sellers

Sellers are not entitled to a refund for platform fees deducted from their earnings.

If a buyer’s refund request is approved, the seller will not receive payment for that order.

Flashy Marketplace reserves the right to withhold seller earnings if there are multiple disputes or refund claims against them.

13. DISPUTE RESOLUTION

13.1 Filing a Dispute

If a buyer and seller disagree on an order, they must first attempt to resolve the issue through the Flashy Marketplace messaging system.

If no resolution is reached, either party can escalate the dispute to Flashy Marketplace Support.

Disputes must be raised within 14 days of order completion.

13.2 Flashy Marketplace’s Role in Dispute Resolution

Flashy Marketplace will review all available evidence, including order details, chat history, and submitted files.

Decisions will be made based on platform guidelines, and the ruling is final.

If the dispute is ruled in favor of the buyer, the payment will be refunded as per the refund policy.

If the dispute is ruled in favor of the seller, the payment will be released.

14. ACCOUNT TERMINATION

14.1 Grounds for Account Termination

Flashy Marketplace reserves the right to suspend or terminate accounts without prior notice if a user:

  • Engages in fraudulent transactions or chargebacks.
  • Attempts to communicate or transact outside the platform.
  • Shares prohibited contact details (email, phone, social media, Google Meet, Zoom, etc.).
  • Fails to deliver services as promised.
  • Has multiple disputes or refund claims against them.
  • Violates Flashy Marketplace’s Terms of Service, Community Standards, or Payment Policies.

14.2 Effects of Account Termination

Terminated users lose access to their accounts, including pending earnings.

Flashy Marketplace reserves the right to withhold payments in cases of fraudulent activities or policy violations.

Users may not re-register on the platform under a new account.

15. PRIVACY AND DATA HANDLING

Flashy Marketplace complies with the IT Act 2000 and the Digital Personal Data Protection Act, 2023.

We collect, store, and use personal data as per our Privacy Policy.

Users have the right to access, modify, or delete their data upon request.

We use cookies and tracking technologies to enhance user experience.

16. SERVICE SPECIFICS

Service Listings must be accurate, ethical, and lawful.

Sellers must meet minimum quality standards for their category.

No plagiarism, AI-generated spam, or misleading services.

Subscription services, if applicable, must comply with Flashy Marketplace’s policies.

17. ACCOUNT SECURITY & DATA BREACHES

Flashy Marketplace will take immediate action in case of a security breach or data leak.

Users will be notified if their data is compromised.

Flashy Marketplace reserves the right to suspend or terminate accounts involved in security violations.

18. CHANGES TO THE PLATFORM

Flashy Marketplace can modify or discontinue services at any time.

Users will be notified of significant changes via email or platform announcements.

19. INTERNATIONAL USERS

Flashy Marketplace operates globally, but users must comply with their local laws and regulations.

Flashy Marketplace is not responsible for regulatory issues outside of India.

20. GOVERNING LAW & JURISDICTION

These Terms are governed by Indian laws, with jurisdiction in Delhi.
